Columbus International Fencing Academy Terms & Conditions Disclaimer
These Terms and Conditions constitute a legally binding agreement between you (the user, member, or parent/guardian of a minor participant) and Columbus International Fencing Academy. By accessing this website, enrolling in classes, or participating in any CBUSIFA programs, you acknowledge that you have read, understood, and agree to be bound by these Terms. Fencing is an athletic activity that carries inherent risks of physical injury, including but not limited to bruising, sprains, fractures, concussions, and in rare cases, more serious injury. Participation requires signed liability waivers and acknowledgment of risk. For minors under 18, a parent or legal guardian must provide written consent and sign all required waivers on behalf of the minor participant. CBUSIFA reserves the right to modify these Terms at any time, and your continued use of our services constitutes acceptance of any changes. If you do not agree to these Terms, you must immediately discontinue use of this website and all CBUSIFA services.

1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you (whether personally or on behalf of a minor child or ward) and Columbus International Fencing Academy, an athletic training facility located at 1160 Steelwood Road, Columbus, Ohio 43230 ("CBUSIFA," "we," "us," or "our"), governing your access to and use of the www.cbusifa.com website and all fencing classes, programs, private lessons, coaching services, and related offerings (collectively, the "Services").
By accessing this website, enrolling in classes, booking services, or participating in any CBUSIFA programs, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with these Terms, you are expressly prohibited from using the website or Services and must discontinue use immediately.
For Parents and Guardians: If you are enrolling a minor (under 18 years of age), you represent that you are the parent or legal guardian with full authority to bind the minor to these Terms, and you agree to be responsible for all obligations hereunder.
2. Who Can Use Our Services
Age and Legal Capacity:
To enroll in CBUSIFA classes or services, you must either:

Be at least 18 years of age and possess the legal capacity to enter into binding contracts under Ohio law; OR

Be a minor (under 18) whose parent or legal guardian has completed registration, signed all required waivers, and provided written consent on your behalf.
USA Fencing Membership Requirement:
All participants must complete USA Fencing registration before participating in any class, lesson, or program offered by CBUSIFA. USA Fencing membership is a prerequisite for participation and is the responsibility of each member or their parent/guardian.
Parental Consent for Minors:
Ohio law requires parental or guardian consent for minors participating in athletic activities. Parents/guardians must sign liability waivers, medical authorization forms, and concussion awareness acknowledgments (Ohio Department of Health Concussion Information Sheet) before a minor may participate.
3. Services Offered
CBUSIFA offers the following services:

Group Fencing Classes: Beginner and competitive classes in foil, épée, and sabre for youth and adults

Private Lessons: One-on-one coaching sessions (20-minute sessions)

Private Lesson Bundles: Packages of private lessons for accelerated training

In-Event Coaching: Strip-side coaching during competitions

Collegiate Membership: Discounted membership for currently enrolled college students

Open Fencing: Bouting practice for members and non-members
-
Special Events: Birthday parties, corporate events, and team-building activities
All Services are subject to availability, coach discretion, and compliance with these Terms.
4. Enrollment and Registration
Enrollment Process:
Enrollment is offered on a first-come, first-served basis. Class sizes are limited to maintain optimal coach-to-student ratios.
Required Documentation:
Prior to participation, all members must submit:

Completed USA Fencing registration

Signed liability waiver and release of claims

Medical information and emergency contact forms

Parental consent and indemnification (for minors under 18)

Ohio Department of Health Concussion Information acknowledgment
Account Creation:
You may be required to create an account on our website or booking platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. Payment and Billing
Payment Terms:
Monthly class and package fees are due in advance, payable by the first class of each month. Payments can be made online by credit/debit card or via other approved payment methods.
CBUSIFA reserves the right to change pricing at any time. Changes will be communicated via email and/or posted on the website. Continued use of Services after price changes constitutes acceptance of new pricing.
Late Payment:
Failure to pay on time may result in suspension of participation until the balance is settled.
Third-Party Payment Processing:
Payments are processed by third-party payment processors (such as Wix, Square, or other approved platforms). CBUSIFA does not store full credit card information.
6. Refunds and Cancellations
Refund Policy (Ohio Law Compliance):
Under Ohio law, businesses are not required to offer refunds but must conspicuously post their refund policy if they have one. CBUSIFA's refund policy is as follows:
All payments are non-refundable except in cases of:

Medical emergencies (with documentation from a licensed physician); OR

Club-initiated program cancellations
No Refunds or Credits for:

Missed classes or lessons

Schedule changes initiated by the member

Failure to attend scheduled sessions
Makeup Sessions:
Makeup sessions may be offered at CBUSIFA's discretion based on coach availability. To request a makeup class, members must notify CBUSIFA at least 5 hours in advance. Makeups are not guaranteed.
Private Lesson Package Expiration:
Private lesson packages must be used within 60 days of purchase unless otherwise specified.
Refund Method:
If a refund is issued, it will be processed to the original payment method within 30 days of approval.
7. Program Transfers and Upgrades
Members wishing to transfer between classes or upgrade their plan should contact CBUSIFA administration. Transfers and upgrades are subject to class availability and may require an adjustment in fees.
8. Attendance and Makeups
Members are encouraged to attend all scheduled sessions to maximize progress. To request a makeup class, notify CBUSIFA at least 5 hours in advance. Makeups are subject to availability and not guaranteed.
9. Safety, Conduct, and Facility Rules
Safety Protocols:
All participants must follow safety protocols and club rules at all times. Respectful behavior toward coaches, staff, and fellow members is required.
Right to Dismiss:
CBUSIFA reserves the right to dismiss any participant for misconduct, safety violations, or failure to comply with these Terms. No refunds will be issued for dismissals due to participant misconduct.
Assumption of Risk:
Fencing is an athletic activity that involves inherent risks of physical injury, including but not limited to bruising, sprains, fractures, concussions, sudden cardiac events, and in rare cases, more serious injury or death. By enrolling in CBUSIFA Services, you (or your parent/guardian if you are a minor) acknowledge and assume these risks.
10. Equipment
Provided Equipment:
CBUSIFA provides basic fencing equipment for beginners and trial classes. Members may need to obtain their own gear as they advance.
Equipment Care:
All equipment should be used responsibly and returned in good condition. Members are responsible for damage to equipment caused by misuse or negligence.
Personal Equipment:
Members who purchase personal equipment are responsible for ensuring it meets USA Fencing safety standards.
11. Liability Waiver and Release
Waiver for Adults:
By enrolling in CBUSIFA Services, you acknowledge the inherent risks of fencing and agree to release and hold harmless CBUSIFA, its owners, coaches, staff, affiliates, and agents from any and all claims, damages, injuries, or losses arising from your participation, including those arising from the ordinary negligence of CBUSIFA.
Waiver for Minors (Ohio Law):
Ohio law permits parents and guardians to waive liability on behalf of minor children participating in nonprofit athletic activities. While CBUSIFA is a for-profit entity, Ohio courts have not definitively ruled on the enforceability of parental waivers for for-profit sports organizations. By signing the waiver on behalf of your minor child, you acknowledge and assume the risks of fencing participation on their behalf and agree to indemnify CBUSIFA for any claims arising from your child's participation.
Concussion Awareness (Ohio Law):
Ohio law requires that participants and parents/guardians acknowledge receipt of the Ohio Department of Health Concussion Information Sheet. CBUSIFA coaches are trained in recognizing symptoms of concussions and head injuries and will remove any athlete exhibiting signs of concussion from participation.
Medical Authorization:
In the event of a medical emergency, you authorize CBUSIFA staff to obtain emergency medical treatment for you or your minor child.
12. Intellectual Property Rights
Ownership:
All content on the CBUSIFA website, including text, graphics, logos, images, videos, class descriptions, and software, is the exclusive property of CBUSIFA and is protected by United States copyright, trademark, and intellectual property laws.
Prohibited Uses:
You may not reproduce, distribute, modify, copy, publicly display, publicly perform, publish, adapt, edit, or create derivative works of any CBUSIFA content without prior written permission.
USA Fencing and School Trademarks:
CBUSIFA members may not use USA Fencing logos, trademarks, or CBUSIFA branding in any commercial or promotional materials without written permission.
User-Generated Content:
If you upload content (such as photos, videos, or testimonials) to CBUSIFA's website or social media channels, you represent that you own all rights to such content or have obtained all necessary licenses. By uploading content, you grant CBUSIFA a non-exclusive, royalty-free license to use, display, and distribute such content for promotional purposes.
13. Photography and Video Release
Media Consent:
By participating in CBUSIFA programs, you (or your parent/guardian if you are a minor) consent to CBUSIFA photographing and video recording your participation for promotional, instructional, and archival purposes. Such images and videos may be used on CBUSIFA's website, social media channels, and marketing materials.
Opt-Out:
If you do not wish to be photographed or recorded, you must notify CBUSIFA in writing prior to participation.
14. Holidays and Closures
CBUSIFA will notify members of scheduled closures or holidays in advance via email and/or website posting. Makeups for club-initiated cancellations will be coordinated whenever possible.
15. Communication and Updates
All official communication, schedule changes, and updates will be sent via email and/or posted on the CBUSIFA website or member portal. It is your responsibility to check your email regularly and keep your contact information current.
Promotional Communications:
By enrolling in CBUSIFA Services, you agree to receive promotional emails and updates from CBUSIFA. You may opt out of promotional communications at any time by clicking "Unsubscribe" in any email or contacting us directly.
16. Right to Suspend or Cancel Membership
CBUSIFA reserves the right to permanently or temporarily suspend or terminate your access to Services without notice or liability for any reason, including if you violate any provision of these Terms or applicable law.
You may discontinue use and request to cancel your membership at any time by contacting CBUSIFA administration. No refunds will be issued for cancellations except as specified in Section 6.
17. Indemnification
You agree to indemnify, defend, and hold harmless CBUSIFA, its owners, coaches, staff, affiliates, and agents from any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

Your use of CBUSIFA Services or facilities

Your breach of these Terms

Your violation of any law or regulation

Your violation of the rights of any third party

Any injury or damage caused by you or your minor child
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY OHIO LAW:
CBUSIFA, ITS OWNERS, COACHES, STAFF, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE CBUSIFA SERVICES

ANY CONDUCT OR CONTENT OF ANY THIRD PARTY

UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR PARTICIPATION IN FENCING ACTIVITIES
CBUSIFA ASSUMES NO LIABILITY FOR:

Errors, mistakes, or inaccuracies of content

Personal injury or property damage resulting from your use of Services

Any unauthorized access to or use of our servers or personal information stored therein
19. Modifications to Terms
CBUSIFA reserves the right to modify these Terms at any time at its sole discretion. When material changes are made, CBUSIFA will notify members via email and/or post an updated version on the website with a new "Last Updated" date.
Your continued use of CBUSIFA Services after such notification constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must immediately discontinue use of Services.
20. Governing Law and Dispute Resolution
Governing Law:
These Terms and your use of CBUSIFA Services are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles.
Jurisdiction and Venue:
Any legal action or proceeding arising out of or relating to these Terms or CBUSIFA Services shall be brought exclusively in the state or federal courts located in Franklin County, Ohio. You consent to the personal jurisdiction of such courts and waive any objection to venue.
Consumer Protection:
These Terms are subject to the Ohio Consumer Sales Practices Act (Ohio Rev. Code § 1345.01 et seq.). Nothing in these Terms shall limit your rights under Ohio consumer protection laws.
21. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall remain in full force and effect.
22. Entire Agreement
These Terms, together with the Privacy Policy and any signed liability waivers, constitute the entire agreement between you and CBUSIFA regarding use of Services and supersede all prior or contemporaneous understandings.
23. Waiver
CBUSIFA's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
24. Electronic Communications and Signatures
By accessing CBUSIFA's website, sending emails, and completing online forms, you consent to receive electronic communications. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
You agree to the use of electronic signatures, contracts, orders, and other records, and to electronic delivery of notices, policies, and records of transactions.
