REFUND POLICY

Columbus International Fencing Academy

1. General Refund Policy

All payments made to Columbus International Fencing Academy ("CBUSIFA") are non-refundable except as specifically provided in this policy.​

This policy applies to:

  • Monthly class memberships and fees

  • Private lesson packages and bundles

  • Drop-in class fees

  • Competition strip coaching fees

  • Special event fees (birthday parties, corporate events)

  • Equipment purchases

  • Registration and enrollment fees

2. Ohio Law Compliance

Conspicuous Posting Requirement:
Under Ohio Revised Code Chapter 1345 (Ohio Consumer Sales Practices Act), CBUSIFA is required to conspicuously post this refund policy. This policy is posted:​

  • On the CBUSIFA website (www.cbusifa.com)

  • At the facility entrance

  • At the point of registration/enrollment

  • On service booking pages

  • In confirmation emails

Consumer Rights:
Nothing in this policy limits your rights under Ohio consumer protection laws.​

3. Three-Day Right to Cancel (Ohio Prepaid Entertainment Contract Act)

Buyer's Remorse Period:
Under Ohio's Prepaid Entertainment Contract Act (Ohio Rev. Code § 1345.41 et seq.), all members have the right to cancel their membership contract within three (3) business days of signing the contract and receive a full refund of all monies paid.​

How to Exercise This Right:

  • Cancellation must be in writing (email, letter, or in-person written notice)​

  • The cancellation notice must be postmarked or delivered by midnight of the third business day after signing the contract​

  • Send written cancellation to:

    • Mail: Columbus International Fencing Academy, 1160 Steelwood Road, Columbus, OH 43230

    • In-person: Deliver written notice to CBUSIFA administration

Refund Processing:
If you cancel within the three-day period, CBUSIFA will refund 100% of all payments within thirty (30) days of receiving the cancellation notice.​

Notice of Cancellation Form:
At the time of enrollment, CBUSIFA provides a "Notice of Cancellation" form as required by Ohio law. This form explains your right to cancel and provides a template for written cancellation notice.​

4. Exceptions to Non-Refund Policy

CBUSIFA will issue prorated refunds or credits in the following circumstances:

A. Medical Emergency or Disability

If you or your minor child becomes disabled or injured and can no longer safely participate in fencing activities, CBUSIFA will issue a prorated refund for the unused portion of your membership.​

Required Documentation:

  • Written notice of disability or injury

  • Letter from a licensed physician stating that continued participation is medically inadvisable

  • Physician's letter must specify the nature and duration of the disability/injury

Refund Calculation:
The refund will be calculated on a prorated basis, reflecting the number of days remaining in the current billing cycle, minus any days in which services were made available free of charge.​

Processing Time: Refunds will be issued within thirty (30) days of receiving proper documentation.​

B. Relocation

If you relocate to a residence that is more than twenty-five (25) miles from CBUSIFA's facility and there is no comparable fencing facility within twenty-five (25) miles of your new residence, you may cancel your membership and receive a prorated refund.​

Required Documentation:

  • Written notice of relocation

  • Proof of new address (lease agreement, utility bill, driver's license, etc.)

  • CBUSIFA may verify that no comparable fencing facilities exist within 25 miles of your new residence​

Refund Calculation:
The refund will be calculated on a prorated basis for the unused portion of your membership, minus any free trial or promotional periods.​

C. Club-Initiated Program Cancellations

If CBUSIFA cancels a class, program, or service due to insufficient enrollment, coach unavailability, facility closure, or other club-initiated reasons, members will receive:​

  • A full refund for the cancelled service; OR

  • Credit toward another CBUSIFA program or service of equal or greater value; OR

  • Makeup sessions scheduled at a mutually agreed time​

Notification:
CBUSIFA will notify affected members via email and/or phone as soon as reasonably possible when a club-initiated cancellation occurs.​

D. Facility Closure or Permanent Relocation

If CBUSIFA permanently closes its facility or relocates more than ten (10) miles from the current location, all active members will receive a prorated refund for the unused portion of their memberships.​

Refund Calculation:
Refunds will be calculated on a prorated daily basis from the date of closure or relocation.​

5. No Refunds or Credits For

The following circumstances do NOT qualify for refunds or credits:

  • Missed classes or lessons due to member absence, scheduling conflicts, illness (other than qualifying medical disability), vacation, or personal reasons​

  • Schedule changes initiated by the member​

  • Failure to attend scheduled sessions​

  • Voluntary cancellation after the three-day buyer's remorse period (except for qualifying medical emergency, disability, or relocation)​

  • Dismissal for misconduct, safety violations, or breach of Terms and Conditions​

  • Dissatisfaction with coaching, program structure, or results​

  • Change in personal circumstances (work schedule, financial hardship, loss of interest, etc.) that do not qualify under medical or relocation exceptions​

  • Equipment purchases (all sales final unless defective)​

  • Competition strip coaching fees (once service is booked and coach availability is confirmed)​

  • Drop-in class fees​

  • Guest passes​

6. Makeup Sessions (Alternative to Refunds)

Instead of refunds for missed classes, CBUSIFA offers makeup sessions at the club's discretion.​

Makeup Session Policy:

  • Members must notify CBUSIFA at least five (5) hours in advance of a missed class to request a makeup​

  • Makeup sessions are subject to coach availability and class capacity​

  • Makeups are not guaranteed​

  • Makeups must be scheduled and used within thirty (30) days of the original missed class​

  • No makeups are provided for no-shows or late cancellations (less than 5 hours notice)​

7. Private Lesson Package Expiration

Private lesson packages and bundles must be used within sixty (60) days of purchase unless otherwise specified.​

  • No refunds will be issued for unused lessons after the 60-day expiration period​

  • No extensions will be granted except in cases of qualifying medical emergency or disability (with physician documentation)​

  • Members are responsible for scheduling lessons in advance to ensure usage within the expiration period​

8. Refund Method and Processing Time

Refund Method:
All approved refunds will be issued to the original payment method used for the purchase:​

  • Credit card refunds: Credited back to the original card

  • Debit card refunds: Credited back to the original card

  • Cash payments: Refunded by check

  • Electronic funds transfer (EFT): Refunded by check or EFT to the original account

Processing Time:
Approved refunds will be processed within thirty (30) days of approval and receipt of all required documentation.​

Credit Card Processing Fees:
For refunds issued more than 24 hours after payment, credit card processing fees (approximately 2.9% + $0.30 per transaction) are non-refundable and will be deducted from the refund amount.​

9. Cancellation Procedures (After Three-Day Period)

To cancel your CBUSIFA membership after the three-day buyer's remorse period:

  1. Submit a written cancellation request via:

    • Email: cbusifa2024@gmail.com

    • In-person: Deliver to CBUSIFA administration

    • Mail: 1160 Steelwood Road, Columbus, OH 43230

  2. Provide at least thirty (30) days advance notice prior to your desired cancellation date​

  3. All outstanding balances must be paid in full before cancellation is processed​

  4. If you qualify for a refund under Section 4 (medical emergency, disability, or relocation), include required documentation with your cancellation request​

  5. CBUSIFA will confirm receipt of your cancellation request via email within five (5) business days​

No Refund After Cancellation:
Cancellations after the three-day period do not result in refunds unless you qualify under Section 4 exceptions.​

10. Automatic Renewal and Cancellation

Monthly Memberships:
Monthly memberships automatically renew on the first of each month unless written cancellation notice is provided at least thirty (30) days in advance.​

No Prorated Refunds:
Members who cancel mid-month will not receive prorated refunds for the remaining days of that month.​

11. Disputes and Appeals

If you believe you are entitled to a refund that has been denied:

  1. Submit a written appeal to CBUSIFA administration at cbusifa2024@gmail.com, including:

    • Your name and membership details

    • The reason you believe you qualify for a refund

    • Any supporting documentation

  2. CBUSIFA will review your appeal and respond in writing within fifteen (15) business days​

  3. If your appeal is denied and you believe CBUSIFA has violated Ohio consumer protection laws, you may file a complaint with:

12. Policy Updates

CBUSIFA reserves the right to update this Refund Policy at any time. Changes will be posted on the website and at the facility. Your continued use of CBUSIFA services after changes are posted constitutes acceptance of the updated policy.​
